Use of the Website does not transfer any intellectual property rights to the user.

5. Information About Services
The Website may contain information about mobile truck repairs, trailer repairs, roadside assistance, vehicle diagnostics and related technical services.

The information is provided for general informational purposes and does not, by itself, constitute a binding offer to perform a particular repair or intervention.

The availability, scope and timing of services depend on factors including:
– The location of the vehicle.
– The nature and severity of the breakdown.
– The type of vehicle and the required repair.
– The availability of technicians, equipment and spare parts.
– Road access, safety conditions and other operational circumstances.
The Company will communicate the relevant service conditions to the customer before the service is agreed upon.

6. Service Requests and Contract Formation
Submitting an enquiry through the Website, sending an email or making a telephone call does not, by itself, guarantee that a service request will be accepted or that an immediate intervention will be available.

A service agreement is formed when the Company and the customer have agreed to the relevant terms in accordance with the applicable law.

Depending on the circumstances, the agreement may specify:
– The vehicle and its location.
– The requested intervention and its scope.
– The estimated or agreed price.
– Travel and call-out charges, where applicable.
– The estimated arrival time, where available.
– Payment conditions.
– Any additional terms relevant to the particular repair.
Where required by law, the Company will provide the customer with the applicable pre-contractual information and confirmation of the agreement.

7. Prices, Estimates and Additional Work
Prices depend on the nature of the intervention, the time required, the location of the vehicle, the equipment and spare parts needed, and other relevant circumstances.

Any applicable call-out fees, diagnostic charges, labour costs, spare parts costs, taxes and additional charges will be communicated to the customer as required by law and the circumstances of the service.

A preliminary estimate is not a final invoice unless expressly agreed as a fixed price.

If additional work becomes necessary beyond the agreed scope, the Company will seek the customer’s approval before proceeding, except where a different procedure is lawfully agreed or applicable law provides otherwise.

The customer is responsible for paying the agreed charges in accordance with the applicable quotation, service agreement and invoice.

8. Payment Terms
The applicable payment method, payment deadline and any deposit or advance payment requirements will be communicated to the customer before the relevant service is confirmed.

Where advance payment is required, the Company will inform the customer of the amount and payment conditions before dispatch or commencement of work.

Any contractual consequences of late or non-payment will be subject to the agreed terms and applicable law.

Nothing in this section excludes any mandatory rights or protections available to consumers.

9. Cancellations and Service Delays
Customers should notify the Company as soon as possible if they wish to cancel or change a requested intervention.

Any applicable cancellation charges or costs relating to a technician already dispatched will depend on the terms communicated and agreed before the service, together with applicable law.

The Company will make reasonable efforts to provide services within the estimated timeframe communicated to the customer. However, arrival times may be affected by traffic, weather, road conditions, vehicle location, technical complications, parts availability and other circumstances beyond the Company’s reasonable control.

Unless expressly agreed otherwise, estimated arrival times are not guaranteed deadlines.

10. Customer Responsibilities
When requesting a service, the customer must provide accurate and sufficiently detailed information, including, where relevant:
– Vehicle type, registration number and identification details.
– The vehicle’s exact location.
– A description of the fault or breakdown.
– Relevant safety or access restrictions.
– The contact details of the person coordinating the intervention.
The customer must ensure that the service location can be accessed safely and legally and must inform the Company of any known hazards.

The customer is responsible for obtaining any permissions necessary to authorise the requested work on the vehicle.

11. Warranty and Liability
The Company will perform agreed services with appropriate professional care and in accordance with applicable legal requirements.

Any applicable warranty, guarantee or remedy relating to the services or parts supplied will be governed by the relevant agreement and applicable law.

Nothing in these Terms and Conditions excludes or limits liability where such exclusion or limitation is prohibited by law.

Subject to applicable law, the Company shall not be responsible for losses resulting solely from circumstances beyond its reasonable control, nor for pre-existing vehicle defects or faults unrelated to the work performed.

The Company does not guarantee that every breakdown can be repaired at the roadside or that every vehicle can be returned to operation during the initial intervention.

Where an on-site repair is not feasible or safe, further work or alternative arrangements may be required.

12. Personal Data and Privacy
The Company processes personal data in accordance with applicable data protection legislation, including Regulation (EU) 2016/679 (General Data Protection Regulation — GDPR) and relevant Romanian legislation.

Personal data may be processed for purposes such as:
– Responding to enquiries and service requests.
– Arranging and performing requested interventions.
– Managing customer relationships, payments and invoices.
– Meeting legal and regulatory obligations.
– Protecting the Company’s legitimate interests where permitted by law.
– Sending marketing communications where the required legal conditions have been met.
The legal basis for processing depends on the purpose and circumstances of the processing.

Personal data will be disclosed to third parties only where there is an appropriate legal basis, such as when disclosure is necessary to provide a service, comply with a legal obligation or protect legitimate rights.

The Company applies appropriate technical and organisational measures designed to protect personal data against unauthorised access, loss, alteration or disclosure.

Further information about the categories of personal data collected, retention periods, recipients, data subject rights and how to exercise those rights is provided in the Website’s separate Privacy Policy.

Marketing communications will be sent only where permitted by applicable law. Recipients may withdraw consent or object to direct marketing, as applicable.

13. Electronic Communications
Users may communicate with the Company by email, telephone or through contact forms made available on the Website.

Electronic communications may be used to respond to enquiries, confirm service requests, provide quotations, issue relevant documents and communicate information concerning an agreed service.

Where the law requires a specific form of communication or confirmation, the Company will comply with that requirement.

14. External Links
The Website may contain links to external websites operated by third parties.

Such links are provided for convenience and informational purposes only.

The Company does not control external websites and is not responsible for their content, availability, security or privacy practices.

Users should review the terms and privacy policies of any third-party websites they visit.

15. Website Availability and Accuracy
The Company endeavours to keep the Website available and its content reasonably accurate and up to date.

However, the Company does not guarantee uninterrupted access or that all information will always be complete, accurate or free from errors.

The Company may temporarily suspend, modify or discontinue parts of the Website for maintenance, security or operational reasons.

Nothing in these Terms and Conditions excludes liability that cannot lawfully be excluded.

16. Complaints and Dispute Resolution
Customers wishing to submit a complaint about the Website or a service should contact the Company using the contact details provided above.

The Company will make reasonable efforts to review and resolve complaints fairly and promptly.

These Terms and Conditions are governed by Romanian law, subject to any mandatory provisions of applicable European Union law.

Disputes shall be addressed, where possible, through amicable discussions. If no amicable resolution is reached, disputes may be submitted to the competent courts in accordance with applicable law.

Nothing in this section deprives consumers of mandatory rights concerning jurisdiction, complaint procedures or other protections available under applicable law.

17. Applicable Law
These Terms and Conditions are interpreted in accordance with the laws of Romania and applicable European Union legislation.

Where a provision of these Terms and Conditions conflicts with a mandatory legal requirement, the relevant legal requirement shall prevail. The remaining provisions shall continue to apply to the extent permitted by law.

18. Final Provisions
If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall remain effective to the extent permitted by law.

Failure by the Company to exercise a right under these Terms and Conditions does not constitute a waiver of that right.

These Terms and Conditions, together with any applicable quotation, service agreement and the Website’s relevant policies, form the framework governing the use of the Website and the services provided by the Company.
